Important Information - You Must Read!



Has your Tenancy Agreement past the 6 or 12 month period?     
    
If Yes, You WILL NOT be charged any cancellation or advertising charges. However, you are required to give Spackman Real Estate 21 days written notice prior to vacating the premises.

If No, You WILL be responsible for paying the rent until the end of your tenancy or when a new tenant has been approved and commences paying rent, which ever happens first. You will also be responsible for one weeks rent as a cancellation fee and a once off of $50.00 as an advertising fee. These charges will be included with any outstanding rent that takes you up until the end date or your vacating. These charges and any outstanding rent must be paid as soon as possible. However, you are required to give Spackman Real Estate 14 days written notice prior to vacating the premises, this notice can be served up to and including the last day of the fixed term.

If Unsure, contact the office and speak to one of our Staff to find out your lease end date or otherwise you will be responsible for the above fees and charges.

Electricity - Telephone - Internet  - Gas Disconnections

It is your responsibility as the current tenant to disconnect any utilities such as electricity, telephone, broadband or internet, gas, foxtel and any other services at your rental property and to ensure to finalise any outstanding accounts as soon as possible. You as the current tenant are responsible for any disconnection fees or charges. Any damages made by having these services disconnected or removed are your responsibility as well.



Condition Reports

When intending to vacate your rental property, remember to pull out your copy of the Condition Report that was issued and signed by you at the beginning of your tenancy. Be aware that and damages or changes made to the property that we’re not outlined in this Condition Report will be your responsibility. On the final inspection date all repairs and changes will need to be rectified prior to the new tenant moving in and any bond monies to be released by the Bond Board to you. Any damages that are not fixed by you will be addressed to the owner, any charges involved will be your responsibility. You will be notified in writing of the damages and will be expected to pay immediately by cash only. If no action is taken, then the monies will be taken out of you bond money (if any). If still no action or no monies available, the matter is taken to a Tribunal hearing and further penalties will apply. Damages and changes do not include fair wear and tear, this is anything from building deterioration over time, reasonable use of the premise by the tenant or ordinary operation of natural elements, even if the property receives excellent care and maintenance.



Returning Keys & Bond Refund

Once the final inspection has been finalised, any repairs or damages have been fixed and the property is left in a respectable and original state, all copies of keys must be handed into the office in order for the Bond money to be released. Any keys missing, lost or damaged will be your responsibility.

Spackman Real Estate will then fill out a claim form for a Bond Refund and lodge it to the Office of Fair Trading. Bond monies are either paid out via a cheque in the names of persons on the lease and Bond Lodgement Form or via an online transfer into a nominated bank account. Any disagreement over how the bond is to be paid out should first be discussed between the parties.

If an agreement cannot be reached, either party may send a claim form to the Renting and Strata Service Branch of the Office of Fair Trading, without the signature of the other party. The bond money WILL NOT be paid straight away. A letter will be sent to the other party advising them of the claim and giving them 14 days to apply to the Tribunal to dispute the claim. If no reply is received within 14 days the bond will then be paid out.

 

Tenant Default Agency

Our office is a member of TICA, which is a tenancy default agency. Should you default in your rent or breech a term of your Tenancy Agreement, the details will be listed with TICA. Once listed, the information will remain on file until the default is rectified. We do look forward to a harmonious agent tenant relationship, and we will only take this course of action when absolutely necessary.
